Application for New Premises Licence

Summary

To determine an application for a New Premises Licence made by The CamperVin Co Ltd, Playing Field, The Avenue, Bourton-on-the-Water, Gloucestershire.

 

Recommendation

That the Licensing Sub-Committee is asked, in light of the representations received, to consider the application and determine whether to:-

• grant the application as requested.

• grant the application subject to such conditions that are necessary to promote the licensing objectives.

• refuse the application in whole or in part where it is necessary in order to promote the licensing objectives.

Minutes:

The Chair reminded the Committee of the four licensing objectives to be considered when determining the application: the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm.

 

The Licensing Officer presented an application for a new premises licence for Campervin Co Ltd, Bourton-on-the-Water, seeking permission to sell alcohol for consumption on the premises between 12.00 noon and 7.00 pm, with opening hours from 11.30 am to 7.00 pm, from 22 July to 31 August. No representations had been received from the Responsible Authorities and that conditions had been agreed with Gloucestershire Constabulary.

The available options were outlined as granting the application as submitted, granting it subject to additional conditions, or refusing the application in whole or in part where necessary to promote the licensing objectives.

 

Apart from the Town Council, there had not been any negative comments from statutory consultees.

 

  • The applicant outlined the proposal as a family-friendly, community-focused summer event, based on a similar event successfully operated in Cheltenham over the previous three years without complaints.
  • It was explained that the event had the support of the Cotswold School, with the use of the school playing fields providing a fundraising opportunity for the school and local charities.
  • The proposed event would comprise a marquee, café, bar and local street food vendor, with an emphasis on locally sourced food and drink. No live music or late-night entertainment was proposed, with alcohol sales and opening hours ending at 7.00 pm.
  • The applicant stated that the event was intended to complement the village by providing a low-key venue for residents and visitors, rather than attracting significant additional traffic or visitors, and could help reduce pressure within the village centre by encouraging longer visitor stays in an alternative location.

 

Members of the Sub-Committee asked a series of questions and noted that:

·         The event would have a maximum capacity of approximately 200 people at any one time, based on the available seating and site layout.

·         The applicant would be responsible for managing litter on the site, with waste and recycling facilities provided and regular clearance undertaken throughout the event. Waste would be disposed of using the school's existing commercial waste arrangements.

  • It was confirmed that no live music was proposed. Low-level background music may be played, with the intention of minimising any disturbance to the local community.

·         Alcohol sales and trading would cease at 7.00 pm, with customers expected to have left the site by approximately 7.15 pm. Any remaining clearing up would take place after the site had been secured in agreement with the school.

·         The application related only to the school summer holiday period each year. A permanent premises licence had been sought to avoid the need for a new application each year, although the event would not operate during school term time.

 

The lawyer sought clarification regarding the operating dates to ensure that any licence accurately reflected the intended period of operation during the school summer holidays.  Clarification was provided that the event would operate only during the school summer holidays. Whilst the exact dates may vary slightly each year to reflect school term dates, it was agreed that the licence would specify fixed operating dates, with the applicant confirming that the event would not operate outside the school holiday period.

 

Decision:

The Sub-Committee took into account the requirements to promote the four licencing objectives and relevant representation from the parish council residents and the relevant authorities. The sub-Committee also had regard to the statutory guidance under section 182 of the Licencing Act 2003 and the Authority’s Statement of Licencing Policy.

The Sub-Committee decided to grant the premises licence for these activities. This is between the 10th of July and the 10th of September and from 12 noon to 7pm, seven days a week.

Subject to the following conditions:

  • The mandatory conditions of the Licencing Act 2003,
  • Proposed conditions by the police and
  • The applicant only operate when the Cotswolds School is in summer recess as defined by the Cotswolds Schools' publicly published dates. For the avoidance of doubt, alcohol may not be sold on term time including INSET days.

 

The reasons for decision:

  • The application does not significantly impact on the four objectives set out in the Licencing Act of 2003.

 

Appeal and review rights.

People who may wish to appeal are reminded that there are rights to appeal against a licencing authority's decision pursuant to the Licencing Act of

2003. An appeal must be made through the Magistrate's Court within 21 days of notification of the Authority’s Decision.

 

There are procedures contained in the Licencing Act 2003 relating to the review of the premises licence. This provision permits nearby residents or businesses or responsible authorities to apply for a review of the premises licence where problems with crime and disorder, public safety, public nuisance and the protection of children from harm are occurring.

 

RESOLVED: to GRANT a New Premises Licence for Campervin, at the Playing Field, The Avenue, Bourton on the Water, liable to the conditions agreed.
