Application for a New Premises Licence

Summary

To determine an application for a New Premises Licence made by SSAJ LTD for Unit 3 Woolrich House, The Waterloo, Cirencester.

Recommendation

That the Licensing Sub-Committee is asked, in light of the representations received, to consider the application and determine whether to:-

• grant the application as requested.

• grant the application subject to such conditions that are necessary to promote the licensing objectives.

• refuse to specify a person in the licence as the premises supervisor.

• refuse the application in whole or in part where it is necessary in order to promote the licensing objectives.

Minutes:

The Licensing Officer introduced the application. The purpose of the application was to determine an application for a New Premises Licence made by SSAJ LTD for Unit 3 Woolrich House, The Waterloo, Cirencester.

No representations from objectors had been received at the meeting.

The Licensing Officer explained the four licensing objectives which the Sub-Committee was required to consider in their determination of the application;

• the prevention of crime and disorder;

• public safety;

• the prevention of public nuisance;

• the protection of children from harm.

Members asked questions to the Licensing Officer, who provided the following answers;

• It was a standard practice for the license of a premise to match up to the opening hours in accordance with statutory guidance.

• As the premises was yet to open and trade, any consideration of anti-social behaviour could only be considered as speculation, so members were advised that this could not be considered a material consideration for the application. However, the license could be reviewed at a later date if issues came up.

• The first name of the applicant was ‘Shine’, the surname ‘Sebastian’, and they would be the premises supervisor. The applicant’s first name had been incorrectly listed as ‘Sebastian’ in parts of the application, this was a typographical error.

• The processes for consultation as detailed in the 2003 Licensing Act had been correctly followed.

Members then asked questions of the applicant’s agent. They stated the following;

• Staff would be trained, and CCTV provided, in order to avoid public nuisance. Members also discussed the number of litter bins, the agent confirmed that the applicant would provide one litter bin.

Members noted that although the Town Council did not object to the application, they recommended that the opening hours of the site be altered due to the residential nature of the locality and to bring it in line with the other shops in the area. The agent stated that they had held previous conversations with the applicant, and that reduced opening hours of 7am-10pm were acceptable, if the Sub-Committee was minded to permit this.

The Licensing Officer stated that the application would need to be looked at on its own merits.

There were no other interested parties in attendance at the meeting.

The Sub-Committee retired for deliberation of the decision. They returned to the room at 2:50pm

Decision

The Chair explained that in order to reduce public nuisance to the nearby residences, the Sub-Committee had decided to grant the application with a reduced time for the sale of alcohol.

RESOLVED: To grant the application subject to the mandatory conditions and the volunteered conditions to promote the licensing objectives;

1. That the sale of alcohol be limited to 7am – 10pm 7 days a week given the locality and mix of residential and businesses to prevent additional public nuisance.

2. CCTV – to provide evidential recordings of any disturbance to public nuisance.

The Chair stated that the license could be reviewed, and if any residents experienced any issues as a result of its granting, to contact Environmental Regulatory Service.
