Application for a New Premises Licence

Summary        

To determine an application for a New Premises Licence made by EI Group Limited at Coach And Horses, Fosseway, Bourton-on-the-Water.

 

Recommendation

That the Licensing Sub-Committee is asked, in light of the representations received, to consider the application and determine whether to:-

  • grant the application as requested.
  • grant the application subject to such conditions that are necessary to promote the licensing objectives.
  • refuse the application in whole or in part where it is necessary in order to promote the licensing objectives.

Minutes:

The purpose of the item was to determine an application for a New Premises Licence made by EI Group Limited at Coach and Horses, Fosseway, Bourton-on-the-Water.

 

The Licensing Officer introduced the item and explained the changes that the applicant was proposing from the original application.

  • A reduction in the hours applied for recorded music and the sale of alcohol, these were now 11am-11pm, 7 days a week
  • A reduction in live music, now 12pm-11pm, 7 days a week
  • Removal of plays, films, indoor sporting events, performance or dance or anything similar, and late night refreshments entirely
  • Removal of all timings considered non-standard, save for New Year’s eve and Christmas Eve (11am-12:30am)
  • The sale of alcohol and playing recorded music indoors only
  • A proposed condition had been added; for no live music to take place outside after 9pm
  • The amendment of condition 3 to read “all windows and doors to be closed when live and/or recorded music is taking place”
  • The removal of conditions 1,4,5,7 and 8, as they were no longer relevant given the amendments proposed.

 

The Licensing Officer explained that under the Council’s procedure each application that comes before the Committee would be determined on its own merits, and it would take its decision based on:

  • The merits of the application;
  • The promotion of the four licensing objectives;
  • The council’s statement of licensing policy,
  • A copy of which of which can be obtained from the licensing section at Cotswold District Council;
  • The amended guidance issued by the Home Office in April 2018 under section 182 of the Licensing Act 2003.

 

The officer also explained that the objections in the annex had been withdrawn provided the amendments above had been accepted by the Sub-committee.

 

The applicant’s representative then addressed the Sub-committee, raising the following points:

·         The opening times would be amended to 7am-11:30pm (an earlier opening time to reflect the reduced licensing hours)

·         The application included the provision of late-night food on the non-standard opening hours

 

The Applicant’s representative the background to the application:

·         EI group owned the pub, which had operated as a pub for over 400 years, and was considered an asset of community value

·         The pub had been previously successfully trading as an Indian-style restaurant but had now closed. As the previous tenant had been the holder of the license, EI group needed to reapply for the license to market it.

·         The application was for the original terms of the license, but as the applicant appreciated that these were largely historical and had agreed to reduce these, as outlined above, considering the parish council’s objections

·         The pub had been marketed on the website of Stonegate (which was the company that owned EI group), but they would be seeking to market it on a national scale going forward.

·         The license would transfer to the new tenant, if one was found.

The Committee adjourned to deliberate at 14:22 and reconvened at 14:35.

 

The Chair re-opened the meeting, explaining that the Sub-committee had resolved to grant the application. In doing so, they had taken into account representation. The Chair stated that the Sub-committee did not think the application contradicted any of the four licensing objectives and applauded their consultation and engagement with the community.

 

RESOLVED: That the Sub-committee GRANT the premises license, as amended by the applicant.
