The purpose of the report was to consider the pre application proposal for a Private Hire Vehicle Licence from Mr Sebastian D’Avanzo

 

The Licensing Officer introduced the Pre-Application Proposal that had been referred to the Sub-Committee for determination because the proposed Private Hire Vehicle’s age would have passed the age limitations set out in section 5.2 of the Hackney Carriage and Private Hire Policy. The Licensing Office also advised the Sub-Committee that the Pre-Application had the words ’17 Vehicles’ incorrectly inserted into section ‘5.2 Age Policy For Vehicles’.

 

The Licensing Officer stated that the policy states that “The Council has the responsibility to regulate and control all operators, drivers and vehicles used for carrying passengers for hire and reward within the Cotswold District under the provisions of the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976.”. In setting out its Policy, the Council seeks to promote the following objectives:-

·         Safety and health of drivers and the public

·         Vehicle safety, comfort and access

·         To prevent crime and disorder and protect the public.

 

The options for consideration by the Sub-Committee were:

·         To approve the proposal as requested

·         To approve the proposal subject to conditions that are necessary to promote the objectives

·         To refuse the proposal in whole or in part as necessary in order to promote the objectives.

 

 

The Chair invited the Applicant to state their reasons for requiring the licence.

 

The Applicant stated that the license was required to enable a fully restored 1977-1979 Long Wheel Base (2.5ltr petrol) Land Rover to be utilised as a Private Hire Vehicle within a Touring Business based in the Cotswolds.

 

The Sub-Committee noted that the Applicant already held an Private Hire Vehicle Operator License and a Private Hire Vehicle License.

 

The Sub-Committee noted that the application deviated from a conventional Private Hire Vehicle license application as the subject vehicle had not yet been acquired and that, should the Pre-Application be approved, then a Private Hire Vehicle license would be required once the vehicle had been acquired.

 

The Sub-Committee noted that proposed vehicle was not considered to be an ‘Elite Vehicle’ as defined in the policy, and the age of a ‘rebuilt’ vehicle’s was usually determined by the date that its chassis was first registered.

 

The Sub-Committee noted that a maximum of four passengers would be carried in the vehicle at one time (in addition to the driver). One passenger in the front seat and three passengers in the lateral rear bench seat behind.  The two bench seats in the rear compartment (accessed from the rear door) would be removed as part of the vehicle rebuild and the Private Hire License would enable the vehicle to be driven ‘off-road’, although this had not been the intention of the Applicant.

 

The Applicant and Officers left the Chamber to enable the Sub-Committee to discuss the application.
