Summary

To determine a new Premises Licence Application made by Brio Retirement Living (Holdings) Limited.

 

Recommendation

That the Licensing Sub-Committee is asked, in light of the representations received, to consider the application and determine whether to:-

·         grant the application as requested;

·         grant the application subject to such conditions that are necessary to promote the licensing objectives;

refuse the application in whole or in part where it is necessary in order to promote the licensing objectives.

The purpose of the Licensing Sub-Committee was to consider and determine a new Premises Licence Application Licence for The Gateway Centre, Spine Road, South Cerney, made by Cotswold Property Destinations Limited

 

The Licensing Officer presented the Application to the Licensing Sub-Committee seeking a Premises for  the following licensable activities and times:

·         Supply by retail of alcohol on and off the premises - Monday to Sunday 10.00 to 00:30 hours

·         Live Music indoors - Monday to Sunday 23:00 to 00:30 hours

·         Recorded Music indoors - Monday to Sunday 23:00 to 00:30 hours

·         Films indoors and outdoors- Monday to Sunday 10:00 to 23:00 hour

 

The Sub-Committee noted the Licensing Objectives.

 

The Sub-Committee noted that it was able to:

·         grant the application as requested

·         grant the application subject to such conditions that are necessary to promote the licensing objectives

·         refuse the application in whole or in part where it is necessary in order to promote the licensing objectives

 

The Sub-Committee considered the application details, location, and site plan and asked a number of questions regarding what was being proposed.

 

The Sub-Committee noted that no representations had been made by any authorities under the Licensing Act 2003.

 

The Sub-Committee noted the representation of the South Cerney Parish Council, and their concerns regarding noise, congestion and the appropriateness of the proposal in a rural location

 

The Sub-Committee noted that no comments had been made by the Ward Member.

 

The Sub-Committee adjourned to deliberate and reach their decision.

 

The Sub-Committee re-convened and announced their decision was to grant the licence, subject to a noise management plan having been submitted and approved before any late-night events were held.

 

The Licensing Sub-Committee had arrived at its decision unanimously, after taking into account the requirement to promote the four licensing objectives, the relevant representations, Statutory Guidance under Section 182 of the Licensing Act 2003 (as amended) and the Council’s Statement of Licensing Policy.
